UNDERSTANDING UCSF's E-DISCOVERY OBLIGATIONS

Governor Schwarzenegger has signed into law the new California E-Discovery Act. It is effective immediately as of June 29, 2009. The Act is very similar to the existing Federal Rules of Civil Procedure which cover discovery and preservation of Electronically Stored Information (ESI) in matters where litigation is in process or reasonably likely to occur, thus bringing state law into line with existing requirements for federal court cases. Below are links to the new California law as well as the current Federal Rules on E-Discovery.
